1) Scope and Provider

These general terms and conditions (GTC) apply to sales contracts with private customers and companies that are concluded via this website (www.minikauf.ch).

The order is confirmed by the provider. The contract is concluded as soon as the buyer receives the confirmation. If the confirmation is not received within a reasonable period of time, the buyer considers this as a refusal of the order and is entitled to conclude the contract with another supplier.

Our deliveries, services and offers are made exclusively on the basis of these General Terms and Conditions. The general terms and conditions also apply to companies for all future business relationships, even if they are not expressly agreed again. The inclusion of a customer's general terms and conditions that contradict our general terms and conditions is already contradicted.

Contract language is exclusively German.

2) Conclusion of contract

The presentation of goods in the online shop does not constitute a binding application for the conclusion of a purchase contract. Rather, it is a non-binding invitation to order goods in the online shop.

By clicking on the "Send order" button, you submit a binding purchase offer.

After receipt of the purchase offer, you will receive an automatically generated e-mail in which we confirm that we have received your order (confirmation of receipt). This confirmation of receipt does not constitute acceptance of your purchase offer.

A contract does not come about through the confirmation of receipt.

A purchase contract for the goods is only concluded if we expressly declare our acceptance of the purchase offer or if we send the goods to you - without a prior express declaration of acceptance.

3) prices

The prices are given in CHF. VAT and advance recycling fee and handling are included.

The provider reserves the right to change prices at any time. The prices published on the website on the order date apply to customers.

4) Terms of Payment

Payment can be made either: by bank transfer , PayPal, credit card, Shop Pay, Apple Pay, Google Pay, Sofort, Ideal, Bancontact or cryptocurrencies.

If you select the payment method bank transfer , we will give you our bank details in the order confirmation. The invoice amount is to be transferred to our account within 30 days of receipt of the order confirmation.

When paying by credit card, the purchase price will be debited from your credit card at the time the order is placed.

5) Liability

The provider undertakes to ensure state-of-the-art security in systems, programs, etc. that belong to him and over which he has influence, and to follow the rules of data protection.

Customers must ensure the security of the systems, programs and data that are in their sphere of influence. In their own interest, customers should keep passwords and user names secret from third parties.

The provider is not liable for defects and faults for which he is not responsible, especially not for security deficiencies and operational failures of third-party companies with whom he works or on which he is dependent.

Furthermore, the provider is not liable for force majeure, improper action and disregard for the risks on the part of the customer or third parties, excessive stress, unsuitable equipment of the customer or third parties, extreme environmental influences, interventions by the customer or disturbances by third parties (viruses, worms, etc.) that happen despite the necessary current safety precautions.

Claims for damages from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort are excluded against minikauf.ch / P. Steiner and against the dealers, unless intentional or grossly negligent action is involved. Liability for indirect damage and consequential damage resulting from use, faulty performance or loss of performance is excluded.

Minikauf.ch / P. Steiner can change, limit or discontinue the scope and functionalities of the online shop at any time. The online shop may be temporarily unavailable due to maintenance work. This can lead to data loss. In this context, minikauf.ch / Patrik Steiner is not liable.

The parties concerned are solely responsible for the proper and contractual performance of the contracts between customers and dealers. minikauf.ch / P. Steiner cannot be held responsible for this and assumes no liability.

6) Application of law and place of jurisdiction

Swiss law applies to these General Terms and Conditions, namely the provisions of the Swiss Code of Obligations.

The court at the place of residence of the seller is responsible for complaints by a customer. The court at the domicile of the defendant party is responsible for complaints by the provider.

7) Right of Withdrawal and Right of Withdrawal

The customer can request a refund of the purchase price or a reshipment if they have not received the product within the guaranteed time. (60 days not including 2-5 days processing)

The customer can request a refund or reshipment if they received the wrong item.
If the customer does not want the product, the customer has no right to a return or refund without any reason. If the item needs to be returned, you must always first send an e-mail to Minikauf using the contact form .

The item must be unused when returned.

The customer is not entitled to a refund under the following conditions

• The order has not been delivered due to factors within the customer's control (e.g. providing an incorrect shipping address)
• The order was not delivered due to exceptional circumstances beyond Steiner's control (e.g. delayed by a natural disaster).
• Damaged item (other than damaged in transit or defective upon receipt).

Refunds can be requested within 30 days of the guaranteed delivery period (60 days). If the customer is eligible for a refund, the purchase price will be automatically refunded to your credit card or original payment method (within 14 days).

All packages that are provided without a return form or e-mail will be returned to the sender immediately.

8) Guarantee

The buyer must check the delivered goods as soon as possible and report any defects immediately. The responsible customer service can be contacted using the contact form.

The right of the buyer to claim damages remains reserved in all cases.

9) Terms of delivery / shipping costs

Shipping is free on all orders.

All orders are processed within 24 business hours. For logistical reasons, most of the products are sent directly from the foreign manufacturer to the customer, which means that delivery usually takes 7-30 working days. The guaranteed delivery time is 60 days . Deliveries that cannot be made within the guaranteed time will be fully refunded at the customer's request.

We are not liable for successfully delivered packages that disappear in front of the front door.

10) Final Provisions

All legal relationships between the customer and Minikauf.ch are subject to Swiss law, to the exclusion of the Vienna Sales Convention.

Should individual provisions of these General Terms and Conditions, including this regulation, be wholly or partially invalid, or should the conditions contain a gap, the validity of the remaining parts shall remain unaffected. Instead of the ineffective or missing provisions, the respective legal regulations or, if they do not exist, provisions that correspond to the meaning of the ineffective provisions apply.
