1) Scope and Provider

The online shop is an offer from the Swiss Steiner E-Commerce (hereinafter the "Provider") with selected goods and services. The general contact address and further information about the Provider can be found in the Imprint.

These General Terms and Conditions (GTC) of the Provider, Hintergasse 20, 9620 Lichtensteig, regulate the rights and obligations of both the Provider and the customers of this website www.minikauf.ch. Exclusively these GTC apply. For individual or additional offers, supplementary or further conditions may exist. Information about data protection can be found in the Privacy Policy.

The order will be confirmed by the Provider. The contract is concluded as soon as the confirmation reaches the buyer. If the confirmation is not received within a reasonable period, the buyer considers this a rejection of the order and is entitled to conclude the contract with another supplier.

Our deliveries, services, and offers are made exclusively on the basis of these General Terms and Conditions. The General Terms and Conditions thus also apply to all future business relationships with companies, even if they are not expressly agreed upon again. The inclusion of General Terms and Conditions of a customer that contradict our General Terms and Conditions is hereby rejected. The contract language is exclusively German.

For better readability, the masculine form is used for personal designations and certain nouns in these General Terms and Conditions (GTC). Corresponding terms apply to all genders in the sense of equal treatment. The shortened linguistic form serves exclusively for editorial purposes and does not imply any judgment.


2) Conclusion of Contract

The presentation of goods in the online shop does not constitute a binding offer for the conclusion of a purchase contract. Rather, it is a non-binding invitation to order goods in the online shop.

By clicking the "Submit Order" button, you submit a binding purchase offer.

After receipt of the purchase offer, you will receive an automatically generated e-mail confirming that we have received your order (acknowledgment of receipt). This acknowledgment of receipt does not yet constitute acceptance of your purchase offer.

A contract is not yet concluded by the acknowledgment of receipt.

A purchase contract for the goods is only concluded when we expressly declare acceptance of the purchase offer or when we send the goods to you - without prior express declaration of acceptance. With the shipment, the benefit and risk pass to the customer.

3) Prices

Prices are stated in CHF. VAT and advance recycling fee as well as processing are included.

The Provider reserves the right to change prices at any time. For customers, the prices published on the website on the order date apply.

4) Payment Terms

Payment can be made optionally by: bank transfer, PayPal, credit card, TWINT, Shop Pay, Apple Pay, Google Pay, Sofort, Ideal or Bancontact.

If you choose bank transfer as the payment method, we will provide you with our bank details in the order confirmation. The invoice amount must be transferred to our account within 30 days of receiving the order confirmation.

When paying by credit card, the purchase price will be debited from your credit card at the time of the order.

5) Intellectual Property Rights

For customizable items, the customer confirms that they are fully authorized (copyright) to the images provided by them for this purpose. Should a third party assert claims against Minikauf.ch, the customer shall fully indemnify Minikauf.ch, including any legal fees.

5) Liability

The provider undertakes to ensure security according to current technical standards in systems, programs, etc., that belong to them and over which they have influence, as well as to comply with data protection regulations.

Customers must ensure the security of the systems, programs, and data within their sphere of influence. Customers should keep passwords and usernames secret from third parties in their own interest.

The provider is not liable for defects and malfunctions for which they are not responsible, especially not for security defects and operational failures of third-party companies with which they cooperate or on which they depend.

Furthermore, the provider is not liable for force majeure, improper conduct and disregard of risks by the customer or third parties, excessive use, unsuitable equipment of the customer or third parties, extreme environmental influences, interventions by the customer or disturbances by third parties (viruses, worms, etc.), which occur despite the necessary current security precautions.

Claims for damages due to impossibility of performance, breach of contract, fault during contract conclusion, and tort, are excluded against the provider and against the dealers, unless there is intentional or grossly negligent action. Liability for indirect damages and consequential damages resulting from use, malfunction, or failure of performance is excluded.

The provider may change, restrict, or discontinue the scope and functionalities of the online shop at any time. The online shop may be temporarily unavailable due to maintenance work. Data loss may occur. In this context, the provider assumes no liability whatsoever.

The respective parties are solely responsible for the proper and contractual fulfillment of contracts between customers and dealers. The provider cannot be held responsible for this and assumes no liability.

6) Applicable Law and Jurisdiction

Swiss law, in particular the provisions of the Swiss Code of Obligations, applies to these GTC.

For lawsuits by a customer, the court at the seller's place of residence is competent. For lawsuits by the provider, the court at the defendant's place of residence is competent. The place of jurisdiction is St. Gallen.

7) Right of Withdrawal and Right of Rescission

The customer can request a refund of the purchase price or a new shipment if they have not received the product within the guaranteed time. (60 days not including 2-5 days processing)

If the customer does not want the product, the customer has no right to a return or refund without providing reasons. If the item needs to be returned, you must always submit a return request in your customer account first.

The item must be unused for a return.

Under the following conditions, the customer is not entitled to a refund:

  • The order was not delivered due to factors within the customer's control (e.g., providing an incorrect delivery address)
  • The order was not delivered due to exceptional circumstances beyond the Provider's control (e.g., delayed by a natural disaster).
  • Damaged item (with the exception of transport damage or defect upon receipt).
  • Special procurement items
  • Batteries and accumulators
  • Data carriers (hard drives, USB sticks, etc.)
  • Other exceptional circumstances beyond the Provider's control

Refunds can be requested within 30 days after the guaranteed delivery period (60 days). If the customer is entitled to a refund, the purchase price will be automatically refunded to your credit card or the original payment method (within 14 days).

Return shipping costs:

We do not cover the return shipping costs unless the fault lies with the Provider.

Exchange:

If you wish to exchange the product for any reason, you must first contact us, and we will guide you through the necessary steps.

If you request a refund, we offer you a voucher for the full purchase price for the Minikauf online shop or give you your money back. We would like to draw your attention to the fact that for a refund, we will deduct a processing fee of 10% of the purchase price (administration and processing fees). For a refund as a Minikauf voucher, we do not charge a processing fee.

Please do not return your order to us unless we ask you to.

General:

Returns can only be accepted if a return form is included or an email is attached after consultation with Minikauf, so that we can easily assign your return to the order placed.

All packages without a return form or email will be immediately returned to the sender.

8) Warranty

The buyer must examine the delivered goods as quickly as possible and report any defects immediately. The competent customer service can be contacted using the contact form.

The buyer's right to claim damages remains reserved in all cases.

9) Delivery Conditions / Shipping Costs

Shipping is free for all orders.

All orders are processed within 24 business hours. For logistical reasons, a large part of the products are shipped directly from the foreign manufacturer to the customer, which usually takes 7-30 working days for delivery. The guaranteed delivery time is 60 days. Deliveries that cannot be made within the guaranteed time will be fully refunded upon customer request.

We are not liable for successfully delivered packages that disappear from the doorstep.

10) Final Provisions

All legal relationships between the customer and the provider are subject to Swiss law, excluding the Vienna Sales Convention.

Should individual provisions of these GTC be wholly or partially void or ineffective, the validity of the remaining provisions shall remain unaffected. The void or ineffective provisions shall be replaced by provisions that economically come closest to the meaning and purpose of the original provisions in a legally effective manner. The same applies to any regulatory gaps.
